THE Hi 5 POKER LEAGUE
SUMMARY OF TERMS AND CONDITIONS
1.1 The Hi 5 Poker League is owned and operated by Hi 5 Promotions Limited, ( “Hi 5”) a company registered in England under company number 09301785 and whose registered office is Sherrington House, 66 Chorley Street, Bolton, BL1 4AL.
1.2 These Terms and Conditions are intended to govern the relationship of The Hi 5 Poker League with participating venues, and in agreeing to join The Hi 5 Poker League, participating venues agree to be bound by them.
2.0 THE Hi 5 POKER LEAGUE
2.1 The Hi 5 Poker League provides the organisation, equipment, league format and other facilities to enable social poker to be played in participating venues.
2.2 For each season of The Hi 5 Poker League, players from each venue can qualify to play in a Semi-Final event, , where they will be in competition with qualifying players from other venues in The Hi 5 Poker League, and from which players can then qualify for an annual Grand Final.
3.0 JOINING THE Hi 5 POKER LEAGUE
3.1 In order to join The Hi 5 Poker League, a venue’s owner / manager/ duly authorised individual must enter the venue’s details into the “venue sign-up form” on The Hi 5 Poker League website, www.hi5pokerleague.com, such details to include their name, telephone number, the venue name, the venue address, a user password and an email address;
3.2 Completing this form will create a free venue account, enabling internet communication with The Hi 5 Poker League to commence.
3.3 The Hi 5 Poker League and the venue will then enter into communications to facilitate the venue’s participation in The Hi 5 Poker League, and an agreement will be finalised in this respect, including all relevant terms with regard to membership, advertising, equipment, playing poker, administration, cost and payment.
3.4 A venue will then be entered into the Hi 5 Poker League, and confirmation will be provided to the venue that this has occurred.
3.5 There is a minimum contract period for new venues of 26 weeks (2 poker seasons).
4.0 OPERATION OF THE Hi 5 POKER LEAGUE
4.1 In order for The Hi 5 Poker League to be administered, participating venues are required to enter the weekly performance of their players on The Hi 5 Poker League website, www.hi5pokerleague.com.
4.2 Venues will be notified of arrangements for Semi-Final and Final events, and invitations will be issued to qualifiers to enable their participation.
4.3 Venues will be charged fees for their participation in The Hi 5 Poker League, the provision of equipment and the entry of their qualifying players to Semi-Final and Final events. These fees will be determined by the schedule of charges then in place for services provided by The Hi 5 Poker League.
4.4 Each venue must appoint a Tournament Director to oversee their participation in The Hi 5 Poker League. The Tournament Director may be the owner, the manager, a member of staff, or a trusted player. In the case of a trusted player, The Hi 5 Poker League website has the functionality to allow the owner/ manager/employee of a venue to upgrade an attached player account to include administration rights over the venue account.
4.5 The Tournament Director must provide his or her email address to The Hi 5 Poker League, and all correspondence in respect of that venue’s participation in The Hi 5 Poker League will be dealt with between The Hi 5 Poker League and the Tournament Director by direct email or by communication through the electronic messaging system on The Hi 5 Poker League website.
5.0 RESPONSIBILITIES OF THE Hi 5 POKER LEAGUE
5.1 Upon agreement being reached for a venue to enter The Hi 5 Poker League, and upon payment being made, The Hi 5 Poker League will be responsible for the following:
5.2 To ensure that the venue account will be made viewable on the “find a venue” system on The Hi 5 Poker League website;
5.3 To ensure that the “edit scores” system and all attached functionality will become available for use on the venue account on The Hi 5 Poker League website;
5.4 To provide any agreed equipment and advertising material to venues to enable poker to be played at the venue and for the venue’s participation in The Hi 5 Poker League to be facilitated;
5.5 To organise and hold Semi-Final events on a seasonal basis and a Grand Final on an annual basis, such events to be staged in accordance with the qualifying and prize formats put in place by The Hi 5 Poker League from time to time;
5.6 To issue Semi-Final invitations to the appropriate qualifying players from a given venue at the end of a season;
5.7 To issue Semi-Final invitations via The Hi 5 Poker League’s internal website messaging system, which is an automated process, and in which the scoreboard edited by the Tournament Director of each venue is utilised for data;
5.8 To issue Final invitations to the appropriate qualifying players from each Semi-Final, utilising The Hi 5 Poker League’s website messaging system;
5.9 To interact with venues and Tournament Directors in a manner which promotes the efficient running of The Hi 5 Poker League.
6.0 RESPONSIBILITIES OF THE VENUE
6.1 To pay all fees and other charges which relate to the venue’s participation in The Hi 5 Poker League when due;
6.2 To contribute positively to The Hi 5 Poker League and to protect it’s reputation and integrity;
6.3 To comply with the Rules of The Hi 5 Poker League and to provide any required information to The Hi 5 Poker League promptly when required to do so;
6.4 To appoint a suitable Tournament Director for the venue;
6.5 To advise The Hi 5 Poker League of the identity of the appointed Tournament Director, and to provide an email address of the venue and of the Tournament Director for communication between The Hi 5 Poker League and the venue;
7.0 RESPONSIBILITIES OF THE TOURNAMENT DIRECTOR
7.1 To provide The Hi 5 Poker League with email details to enable electronic communication between The Hi 5 Poker League and the Tournament Director;
7.2 To take such action as is necessary to ensure that the playing of poker at the venue occurs in a controlled and efficient manner;
7.3 To update the venue’s scoring system via the “edit scores” page on The Hi 5 Poker League website;
7.4 To input scores accurately, since inaccuracies may result in the wrong players from a venue receiving Semi-Final invitations, for which the League accepts no responsibility;
7.5 To ensure players are aware that:
1) points can only be attributed to players who have registered a player account and have attached it to the venue account;
2) players will not earn points in The Hi 5 Poker League until they have assigned their player account to their chosen venue.
8.0 PAYMENT POLICY
8.1 Payments of charges will only be taken by The Hi 5 Poker League from venues who have given their consent and have authorised the payments to be made.
8.2 Invoicing to venues in respect of their future participation in The Hi 5 Poker League will occur in accordance with the individual agreements entered into between The Hi 5 Poker League and each venue, and will be on a monthly, seasonal or annual basis, payable in advance.
8.3 Delivery charges will be payable by venues in respect of the delivery of equipment and any promotional material or collateral.
8.4 Different playing packages will be available to venues depending on the number of poker tables, poker chip sets, and other equipment to be provided, and the number of players a venue wishes to be eligible to be invited to Semi-Final events.
8.5 In the event of a venue wishing to upgrade their package during the course of a season, The Hi 5 Poker League will be entitled to levy a surcharge for the season in respect of additional player invites to Semi Final events, such surcharge being to allow for the additional cost to The Hi 5 Poker League of players attending an event and being eligible to qualify for prizes when their involvement had not previously attracted a charge.
8.6 In the event of a venue wishing to downgrade their payment package, the venue will be required to complete the current season on the terms of their current package.
8.7 In the event that a venue wishes to terminate their participation in The Hi 5 Poker League, they will be liable to pay an additional termination charge of 25% of their current season’s charges for doing so.
8.8 Players from venues will only be invited and entitled to attend Semi Final events if their participating venue has paid the fees and charges of The Hi 5 Poker League which are due. In the event that a venue has not paid these charges, invitations to an event will not be issued until they have done so, and the venue and it’s qualifying players will be notified of this fact.
8.9 Any equipment provided to venues will remain the property of Hi 5 Promotions Limited until payment has been made for it, and The Hi 5 Poker League may require a venue to return equipment to them where it has not been paid for, or will invoice the venue in respect of the cost of its return and any other related charges where they may arise.
9.1 Charges will be levied for a venue’s participation in The Hi 5 Poker League in accordance The Hi 5 Poker League’s schedule of charges at that time in place, full details of which will be available to venues, and upon which VAT will be added.
10.0 METHOD OF PAYMENT
10.1 Venues consent to pay for their subscription to The Hi 5 Poker League, together with ancillary services and equipment, through the online direct debit form that is sent via email during the account creation process.
10.2 A venue will be requested to enter the venue’s bank payment details in the online direct debit form.
10.3 When a venue’s payment details are entered in the direct debit form, and provided the consent of the venue has been given, a payment instruction will be put into effect to enable Hi 5 to obtain payment in accordance with the agreed schedule of charges then in effect.
10.4 For agreed recurring payments in respect of payments due for future seasons of The Hi 5 Poker League, or in respect of payments to be made in the future under an agreed payment plan, an automated recurring invoice and payment process may be put into effect. Any such process will only be activated with the consent of the paying venue, and, for each anticipated payment, an automated email will be sent to the paying party a number of days before payment is to take effect, advising them that the payment is due to be taken on the given day, it’s amount, and that the payment can be cancelled if they wish. The automated advisory email will contain information on how the payment can be stopped by the venue before it takes place.
10.5 Details of this payment system are available at www.gocardless.com.
10.6 Furthermore, our payment system will allow immediate payments to be made by venues at their request.
10.7 No payment or bank details are stored on The Hi 5 Poker League website. All payment details are stored securely on the automated payment system on behalf of the League.
11.1 Any complaints relating to the operation of The Hi 5 Poker League should be directed by email to: [email protected]
12.1 After the minimum contract period of 26 weeks has been completed, venues may terminate their involvement in The Hi 5 Poker League as follows:
12.2 At any time before the commencement of a new season, a venue may give notice to The Hi 5 Poker League in writing, by email or via The Hi 5 Poker League website messaging system that they do not wish to take part in The Hi 5 Poker League for the new season;
12.3 If a venue does not give notice to The Hi 5 Poker League in writing, by email or via the website messaging system that they wish to terminate their involvement in The Hi 5 Poker League, their involvement will continue until they do give notice, and The Hi 5 Poker League will be entitled to assume that they still wish to participate and have agreed to do so;
12.4 Once a venue is registered to join The Hi 5 Poker League, and begins to participate in any season of The Hi 5 Poker League, they will be required to complete that season, and will be liable for any charges due.
12.5 In the event that a venue wishes to terminate their participation in The Hi 5 Poker League, the Hi5 Poker League reserves the right to charge a fee of £35+VAT per poker table provided, and £15+VAT per chip set provided.
13.1 No refunds will be payable by The Hi 5 Poker League for the current season if a venue gives notice that it wishes to terminate its involvement during the course of that season. Semi- Final and Final events are organised upon the number of venues participating in The Hi 5 Poker League for any season, and the number of anticipated players at events, for which forward financial planning and cost will have already been undertaken.
13.2 If a venue has entered an agreement to participate in The Hi 5 Poker League in the future for more than one season, and has paid in advance for more than the current season, they will be entitled to a refund in relation to future seasons, subject to any fees which are chargeable in respect of early termination.
13.3 If a venue has entered an agreement to participate in The Hi 5 Poker League for one year, and the agreement provides for payment to be made monthly, seasonally or annually, the venue will be required to give 3 months notice of termination, and will be liable for any charges due during the period of notice, together with any fees which are chargeable in respect of early termination. A refund will be given for any charges paid in excess of the amount due.
13.4 If a venue has entered an agreement to participate in The Hi 5 Poker League for a period in excess of one year, and the agreement provides for payment to be made monthly, seasonally or annually, the venue will be required to give 6 months notice of termination, and will be liable for any charges due during the period of notice, together with any fees which are chargeable in respect of early termination. A refund will be given for any charges paid in excess of the amount due.
13.5 A full refund will be payable forthwith in respect of any monies paid to The Hi 5 Poker League in error, or paid without the consent and authority of the paying venue.
14.0 DATA PROTECTION AND SECURITY
14.1 Information about each venue and it’s players will not be provided to any third party without their consent.
14.2 The Hi 5 Poker League utilises security techniques and software to protect data from unauthorised access by users inside and outside its website. However, the internet is not a completely secure medium, and although we endeavour to protect the security of the data that we collect and process, we cannot completely guarantee the security of data transmitted to and from our website via the internet, and any transmission or data entry is subject to that risk. The Hi 5 Poker League accepts no liability in respect of any external breach of security relating to data passing over the internet.
15.1 The Rules of The Hi 5 Poker League will be provided to venues, and participating players and venues will be required to adhere to those Rules. The Hi 5 Poker League reserves the right to determine any issue with regard to the application and interpretation of the Rules, and decisions will be taken in their absolute discretion.
15.2 The Hi 5 Poker League reserves the right to refuse any venue or player to participate in the Hi 5 Poker League, or to expel any venue or player in the event of misconduct, or conduct which the Hi 5 Poker League, in its absolute discretion, deems to be contrary to its Rules, procedures, and reputation.
15.3 The Hi 5 Poker League will provide venues with information that clearly sets out the Rules of the Gambling Commission relating to poker in pubs and underage gambling.
15.4 The Hi 5 Poker League is not responsible for administering or enforcing the Rules of the Gambling Commission. It is the responsibility of the owner /manager / operator of each venue to follow the Rules of the Gambling Commission, and any deviation from those Rules is undertaken without the consent of the Hi 5 Poker League. The Hi 5 Poker League and Hi 5 Promotions Limited accepts no liability or responsibility in respect of any breach of these Rules.
15.5 The Hi 5 Poker League and Hi 5 Promotions Limited accepts no liability or responsibility for the breach any legislative or regulatory provisions relating to the use of equipment or the operation of any venue, including any issue relating to Health and Safety or Occupiers Liability.
15.6 The operation of The Hi 5 Poker League generally will be governed by the laws of England and Wales, and any dispute will be determined by the courts of England and Wales.
15.7 “Hi 5”, “Hi 5 Poker League” “Hi 5 Poker”, “Hi 5 Promotions”, “Hi 5 Pool League”, “Hi 5 Quizzes”, “Hi 5 Bingo”, and “Hi 5 Darts League” are trademarks of Hi 5 Promotions Limited.
